Paki Daw Terms of Service
Welcome to Paki Daw! These Terms of Service ("Terms") govern your use of the Paki Daw mobile application and website (collectively, the "Service"), operated by Paki Daw Information Technology Services ("we," "us," or "our").

1. Acceptance of Terms
By creating an account and using our Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the Service.
2. The Service and Local Operators
Paki Daw is a technology platform that connects users who wish to request on-demand errand and home repair services ("Requesters") with independent individuals who wish to provide these services ("Partners", which include Delivery Riders and Handymen).
Local Operators: In certain cities or provinces, the day-to-day operations, partner onboarding, and local support may be managed by independent third-party franchisees known as "Local Operators." Paki Daw Information Technology Services provides the software platform but is not liable for the independent actions, debts, or local disputes handled by these Local Operators.
You acknowledge that Paki Daw does not provide delivery, logistics, home repair, or construction services itself and that all such services are provided by independent third-party contractors (Partners) who are not employed by Paki Daw or its Local Operators.
3. User Accounts and Responsibilities
- You must be at least 18 years old to create an account.
- You are responsible for maintaining the confidentiality of your account and password.
- You agree to provide accurate and complete information.
- You are responsible for all activities that occur under your account.
- Independent Contractor Relationship: Partners are independent contractors, not employees, agents, or representatives of Paki Daw. Paki Daw does not:
- Control Partner schedules, routes, or working hours
- Provide equipment, tools, vehicles, or uniforms (unless part of voluntary loyalty programs)
- Withhold taxes, SSS, PhilHealth, or Pag-IBIG contributions
- Guarantee minimum earnings or task availability
4. Prohibited Conduct
You agree not to use the Service to:
- Post tasks that are illegal, fraudulent, dangerous, or violate any laws. This includes, but is not limited to, the transport of illegal items, engaging in scams, or any form of harassment.
- For 'Paayos' (Repair) Tasks: Post tasks that require specialized professional licenses (unless the Requester independently verifies the Partner holds such license), structural changes requiring building permits, or tasks that pose severe safety hazards.
- For Pedicab Partners: Accept tasks that require crossing, traversing, or navigating along major National Highways. Pedicabs are strictly for hyper-local, intra-community errands. Violation of this safety rule will result in immediate account termination.
- Impersonate any person or entity.
- Use the platform for any purpose other than its intended use for on-demand errands and minor home repairs.
We reserve the right to suspend or terminate accounts found to be engaging in prohibited conduct, as determined in our sole discretion.
5. Payments and Fees
- For Requesters: You agree to pay the final agreed-upon fee for the task completed by the Partner. This includes the Partner's service fee and the cost of any items purchased on your behalf. For repair tasks, the agreed-upon fee covers labor. Costs for materials or replacement parts must be agreed upon separately by both parties and supported by valid receipts.
- Cash Transactions: Paki Daw does not process payments between Requesters and Partners. All financial transactions are conducted directly between the parties (cash, GCash, or other agreed methods). Paki Daw is not responsible for:
- Non-payment or underpayment by either party
- Disputes regarding payment amounts or timing
- Loss of cash or fraudulent payment methods
- Any fees charged by third-party payment providers (e.g., GCash transfer fees)
- For Partners: Paki Daw (or its Local Operator) will charge a platform commission fee on the service fee you earn from each completed task. You are responsible for any taxes on your income.
6. Item Condition, Repair Quality, and Liability
For Padala and Pabili Tasks: Paki Daw provides a photo documentation system to protect both Requesters and Partners.
- Partners: Take photos of items at pickup, during transit (if requested), and at dropoff.
- Requesters: Review photo evidence before accepting delivery. Claims of damage or loss without photo evidence may not be honored.
- Liability: Paki Daw is not liable for damaged, lost, or incorrect items.
For Paayos (Handyman) Tasks:
- No Warranty: Paki Daw does not guarantee or warrant the quality, durability, or safety of the repairs performed by independent Handymen.
- Property Damage: Paki Daw shall not be held liable for any property damage, subsequent failures, or injuries resulting from the repair work. Any claims for damages, substandard work, or incomplete repairs must be resolved directly between the Requester and the Partner.
- Photo Evidence: Both parties are strongly encouraged to take "Before" and "After" photos of the repair site using the platform's photo documentation system to prevent disputes.
7. Partner Insurance and Safety
As independent contractors, Partners are responsible for their own safety and for maintaining appropriate insurance coverage for their vehicles and operations, as required by law. Paki Daw is not responsible for any accidents, injuries, or damages that may occur during the provision of services.
For Handymen: Partners are responsible for bringing their own tools, wearing appropriate personal protective equipment (PPE), and ensuring their own safety while performing repairs. Requesters are expected to provide a safe working environment.
8. Cancellation and Reporting
- Cancellation: Users may cancel tasks according to the rules outlined in the application. Abusing the cancellation feature may result in account suspension.
- Reporting: We provide a "Cancel and Report" feature for Partners who suspect a task is fraudulent or a scam. Misuse of the reporting feature is prohibited. We reserve the right to investigate all reports and take appropriate action, including banning users.
9. Intellectual Property and Software Protection
The Service, including its original content, features, functionality, source code, design, logos, and algorithms, are and will remain the exclusive property of Paki Daw Information Technology Services and its licensors. The Service is protected by copyright, trademark, and other intellectual property laws.
By using our Service, you agree NOT to:
- Copy, modify, distribute, sell, or lease any part of our Service or included software.
- Reverse engineer, decompile, disassemble, or attempt to extract the source code of the software.
- Use any robot, spider, scraper, or other automated means to access the Service for any purpose without our express written permission.
- Create derivative works based on the Service or its design.
Any unauthorized use of our intellectual property will result in immediate account termination and potential legal action.
10. Disclaimers
The Service is provided "as is" and "as available" without any warranties of any kind. We do not guarantee the quality, suitability, safety, or ability of Partners. The entire risk arising out of your use of the Service remains solely with you.
11. Limitation of Liability
To the fullest extent permitted by law, Paki Daw Information Technology Services shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your use of the Service.
12. Data Privacy (RA 10173)
By using Paki Daw, you consent to the collection, use, and storage of your personal information as outlined in our Privacy Policy. This includes:
- Full name, contact number, and address (for task fulfillment)
- GPS location data (during active tasks)
- Photo evidence (uploaded by Partners and Requesters)
- Chat messages between Users
- Automated Analysis: Task titles and descriptions may be processed by automated Artificial Intelligence (AI) systems solely for the purpose of detecting fraud, scams, and ensuring platform safety.
We implement reasonable security measures to protect your data. However, you acknowledge that no internet transmission is 100% secure. You have the right to:
- Request access to your personal data
- Request correction or deletion of inaccurate data
- File a complaint with the National Privacy Commission (NPC)
13. Changes to These Terms
We may modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page. Your continued use of the Service after any modification constitutes your acceptance of the new Terms.
